Pilot Painting & Construction Terms Of Service

These Terms of Service govern the use of services provided by Pilot Painting & Construction (“Company,” “we,” “us,” or “our”) by the client (“you” or “Client”). By requesting a quote, signing a proposal, or contracting services, you agree to these Terms.

1. Scope of Services

Pilot Painting & Construction offers commercial exterior painting, wood repair, stucco resurfacing, iron welding repairs, and related construction services. The specific scope, timeline, and cost of services will be outlined in your project proposal or agreement.

2. Estimates & Proposals

All estimates are provided free of charge and are valid for 30 days unless otherwise noted. Final pricing is subject to change based on:

  • Site conditions

  • Scope revisions

  • Material cost fluctuations

Any changes will be communicated and approved in writing.

3. Project Scheduling

Project start dates are tentative until a signed agreement is received and scheduling is confirmed. We make every effort to meet proposed timelines; however, scheduling is subject to weather conditions, material availability, and site readiness.

4. Site Access & Responsibilities

Client is responsible for ensuring:

  • Clear access to the worksite

  • Removal or protection of personal property

  • Coordination with tenants or residents for notice distribution

Pilot Painting & Construction will provide 3-day advance notice to residents and post daily signage when required.

5. Payment Terms

Payment terms will be outlined in your contract. Typical terms are:

  • A deposit upon contract signing (if applicable)

  • Progress payments as work milestones are met

  • Final payment due upon project completion

Late payments may be subject to interest and collection fees.

6. Workmanship Warranty

Pilot Painting & Construction provides a limited warranty on workmanship and materials, the terms of which will be specified in your project agreement. The warranty does not cover:

  • Damage caused by third parties or external events

  • Work performed outside of the contracted scope

  • Failure due to improper building conditions (e.g., moisture, rot, structural issues)

7. Cancellations & Delays

Cancellations must be submitted in writing. If cancellation occurs after materials have been ordered or work has begun, Client may be responsible for incurred costs. Delays caused by the Client, tenants, or other contractors may impact the project timeline and budget.

8. Insurance & Licensing

Pilot Painting & Construction is fully licensed and insured in the state of California. Proof of insurance and licensing can be provided upon request.

9. Limitation of Liability

We are not liable for incidental or consequential damages arising from delays, property access issues, or unforeseen site conditions. Our liability is limited to the cost of the services provided under the signed agreement.

10. Dispute Resolution

In the event of a dispute, both parties agree to make reasonable efforts to resolve the issue amicably. If necessary, disputes will be settled through binding arbitration in the County of Riverside, California.

11. Amendments

We reserve the right to update these Terms at any time. Any changes will be posted on our website and apply to future service engagements.
